These Terms of Use ("Terms") govern your use of the websites, learning platform, applications, and services of StayQrious India Private Limited ("StayQrious", "Company", "we", "us"), including stayqrious.com and its subdomains, stayq.edu.in and its subdomains, and any other official websites and applications we operate (together, the "Services").
These Terms constitute an electronic record under the Information Technology Act, 2000 and the rules made thereunder, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as amended from time to time. They do not require a physical or digital signature.
Please read these Terms together with our Privacy Policy. By enrolling with StayQrious, registering an account, or using the Services, you agree to these Terms. If you do not agree, please do not use the Services. In the event of any conflict between these Terms and the Privacy Policy on matters relating to personal data, the Privacy Policy shall prevail.
How our school works: StayQrious is an online school. Accounts are created and managed by parents and legal guardians, who enroll their children as students. Throughout these Terms, "you" refers to the parent or legal guardian who has entered into this agreement, acting on behalf of themselves and their enrolled child ("Student").
1. Eligibility and Enrollment
1.1. Enrollment with StayQrious may only be completed by a person who is competent to contract under the Indian Contract Act, 1872, that is, an adult parent or legal guardian. Students do not enter into this agreement directly; you do, on their behalf.
1.2. By enrolling a Student, you confirm that you are the Student's parent or legal guardian, that you are authorised to provide consent on their behalf, and that the information you provide during enrollment is accurate and complete. We obtain verifiable parental consent for the processing of Student data as described in our Privacy Policy.
1.3. Enrollment is personal to your family and is non-transferable. We may decline or terminate enrollment if information provided is found to be materially inaccurate, or in accordance with Section 11.
1.4. Admission to StayQrious may be subject to an orientation conversation and readiness assessment. Admission decisions are made at our reasonable discretion.
2. Accounts and Security
2.1. You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs under your account. Please ensure that the Student accesses the platform using the credentials provided for them.
2.2. Notify us immediately at if you believe your account has been accessed without authorisation. If we have reason to believe an account is compromised or being misused, we may require a password reset or temporarily suspend the account to protect you and other users.
2.3. Access to the Services depends on factors outside our control, such as your internet connection and device. We work to keep the platform available and reliable, but we cannot guarantee uninterrupted access at all times. Where a scheduled class cannot be conducted due to a failure on our side, we will arrange a make-up session or equivalent remedy.
3. Student Conduct and Community Standards
StayQrious classrooms are small, relationship-driven learning communities. We expect students, and the adults around them, to help keep them safe and kind. When using the Services, you and the Student agree not to:
- post or share content that is unlawful, harmful, threatening, abusive, defamatory, obscene, hateful, discriminatory, or invasive of another person's privacy;
- bully, harass, intimidate, or impersonate any student, coach, or other person;
- share other users' personal information without consent;
- upload material that infringes any copyright, trademark, or other intellectual property right, or that you do not have the right to share;
- introduce viruses, malware, or any code designed to harm or interfere with the Services;
- attempt to gain unauthorised access to other accounts, our servers, or networks, or to disrupt or overburden the Services;
- scrape, copy, or systematically extract content or data from the Services through automated means;
- decompile, reverse engineer, or disassemble any part of the platform;
- use the Services for any commercial purpose, or to advertise or solicit; or
- otherwise violate applicable law or these Terms.
We may moderate, remove content, or take action on accounts to keep the learning environment safe, in line with Section 11. We are not responsible for content posted by other users, though we will act on reports of harmful content, please write to .
4. Student Work and Content
4.1. Ownership and license. All work a Student creates, projects, writing, art, recordings of their performances, and other submissions ("Student Work"), remains owned by the Student and their family. However, as a condition of enrollment, you grant StayQrious a perpetual, worldwide, royalty-free, transferable, and sublicensable license to use, host, store, reproduce, adapt, modify, publish, display, distribute, and create derivative works from Student Work, for the following purposes: delivering and operating the Services; maintaining academic records; showcasing and celebrating student learning (including on our websites, social media, and in school communications and marketing materials); curriculum development and exemplars; coach training; and research and improvement of our educational programs and platform.
4.2. Blanket consent, granted once. This license and the associated consent are granted once, at enrollment, and apply to all Student Work created during enrollment. We do not seek separate permission for each individual use. We aim to be transparent about how Student Work is used, and you can always ask us about specific uses at .
4.3. Withdrawal. You may withdraw consent for future uses of Student Work that identifies the Student (for example, work showing the Student's name, face, or voice) at any time by writing to us, as required under applicable data protection law. Withdrawal operates prospectively only: it does not apply to materials already published, distributed, or incorporated into curriculum, training, or other works before the withdrawal, and does not affect uses of de-identified Student Work under Section 4.4.
4.4. De-identified use. Where Student Work is used in a form that does not identify the Student, for example, anonymized exemplars, aggregated research, or program improvement, such use is not subject to withdrawal and may continue indefinitely under the license in Section 4.1.
4.5. Classroom sharing. Student Work shared in class discussions, showcases, and collaborative projects is visible to other students and coaches in the relevant batch or school community. Other students may build on collaborative work as part of the learning process, but no user is granted any right to commercially use another student's work.
4.6. After your child leaves. The license in Section 4.1 survives the end of enrollment with respect to the purposes stated there, subject to your withdrawal rights under Section 4.3 and our Privacy Policy's retention terms for personal data.
4.7. Class recordings. Live classes may be recorded for educational quality, coach development, and student support. Recordings are handled as described in our Privacy Policy. You may not record, distribute, or publish classes or class materials yourself without our prior written consent, this protects the privacy of other children in the class.
5. Our Intellectual Property
5.1. All content and materials we provide, including our curriculum, learning materials, experiment kits and their contents, software, platform, text, graphics, video, audio, trademarks, and logos ("StayQrious Content"), are the property of StayQrious or our licensors and are protected by intellectual property laws.
5.2. We grant you and the Student a limited, personal, non-transferable, non-commercial license to access and use StayQrious Content for the Student's education during enrollment. You may not copy, distribute, republish, sell, or create derivative works from StayQrious Content without our prior written permission.
5.3. Certain content on the Services may belong to third parties and is used with permission; all rights in such content remain with the respective owners.
6. Fees, Payments, and Refunds
6.1. Fees. StayQrious is a paid service. The applicable fees, payment schedules, and inclusions are those communicated to you at the time of enrollment or renewal. All fees are stated inclusive/exclusive of applicable taxes as indicated at the time of payment.
6.2. Payment. Payments are processed through third-party payment providers and are subject to their terms and the terms of your issuing bank or payment instrument. We do not store your full card or bank details. You are responsible for paying fees and applicable taxes on time. Where fees are paid in installments or via EMI, the terms of your bank or financing provider apply to those arrangements.
6.3. All fees are final and non-refundable. StayQrious operates small, fixed-size learning pods with dedicated coaches. When a Student enrolls, we block a seat, allocate coaching capacity, and plan batches around that commitment for the full period paid for, resources that cannot be reallocated mid-term. Accordingly, fees once paid are final, and no refunds are provided for withdrawal, change of mind, non-attendance, missed classes, or scheduling conflicts on your side. Please consider your enrollment decision carefully before making payment.
6.4. The one exception, non-delivery by us. If StayQrious terminates the Student's enrollment without cause, or is unable to deliver Services you have already paid for, we will refund the portion of fees corresponding to the undelivered Services. Refund requests under this Section should be sent to ; approved refunds are initiated promptly and credited as per your bank's timelines. For EMI transactions, your bank's interest and processing terms apply.
6.5. Fee changes. Fees for future terms or renewals may change; we will communicate any change before it applies to you. Fee changes never apply retroactively to periods you have already paid for.
7. Experiment Kits and Shipping
7.1. Some of our programs include hands-on experiment kits and learning materials that we ship to you. Where a kit is included in your program, it will be shipped to the address you provide at enrollment or as updated in your account.
7.2. Address accuracy. You are responsible for providing a complete and accurate shipping address. You may update your shipping address by notifying us in writing reasonably in advance of the scheduled dispatch. If a delivery fails due to an incorrect or incomplete address provided by you, the cost of re-shipping will be borne by you.
7.3. Kit components and additional materials. Some experiments and projects use common household or locally available materials that are not included in the kit; we will inform you in advance of what you need to arrange, and arranging such materials is your responsibility. Please inspect kits on delivery and report any damaged, defective, or missing components to within 7 days of delivery. Where feasible, we will replace such components. Where replacement is not feasible or cannot reach you in time for a scheduled class, we may request that you arrange an equivalent item locally so the Student does not miss the learning experience.
7.4. Safe use. Experiment kits are designed for educational use by the Student under adult supervision, following the safety instructions provided with each kit and during class. Some kit materials are not suitable for unsupervised use by children. You are responsible for ensuring the kit is stored safely and that experiments are conducted as instructed.
7.5. Kits are included in your program fees, are non-refundable per Section 6.3, and are for personal educational use only. Risk in the kit passes to you on delivery.
8. In-Person Programs and Offsites
8.1. From time to time, we may organise optional in-person programs, such as offsites, field trips, meetups, and camps ("Events"). Participation in any Event is entirely optional and is subject to separate registration, applicable Event fees, and a signed parental consent form for each Event.
8.2. Our commitment. We plan Events with reasonable care, including appropriate adult supervision, vetted venues and vendors, and safety protocols suited to the activities involved.
8.3. Your acknowledgements. You acknowledge that travel, outdoor, and physical activities carry inherent risks that cannot be entirely eliminated even with reasonable care, and you accept these inherent risks when you register the Student for an Event. You agree to disclose to us, in the Event consent form, any medical conditions, allergies, or other information relevant to the Student's safe participation.
8.4. Medical care. In a medical emergency during an Event, you authorise us to arrange first aid and emergency medical treatment for the Student, and we will contact you as soon as reasonably possible. Costs of medical treatment are your responsibility unless arising from our negligence.
8.5. Limitation. To the maximum extent permitted by applicable law, StayQrious shall not be liable for injuries, losses, or damages occurring during Events that do not arise from the negligence or wilful misconduct of StayQrious or its personnel. Nothing in this Section limits liability that cannot be limited under applicable law.
8.6. Conduct at Events. Students and accompanying family members must follow the Event guidelines and the instructions of StayQrious staff. We may decline or withdraw a Student's participation in an Event where we reasonably believe it is necessary for the safety or wellbeing of any participant; in that case, any Event-specific fee for the unattended Event will be refunded.
9. Communications
9.1. We will contact you, by email, phone, SMS, and messaging services such as WhatsApp, about the Student's learning, schedules, progress, and important school matters. These service communications are an essential part of running the school.
9.2. Marketing communications are governed by our Privacy Policy, are directed only at parents and guardians, and can be opted out of at any time.
10. Disclaimers and Limitation of Liability
10.1. We are committed to providing a high-quality education and a reliable platform, and we train and support our coaches with care. However, except as expressly stated in these Terms or required by law, the Services are provided without warranties of any kind, express or implied.
10.2. Educational outcomes depend on many factors, including the Student's engagement and circumstances; we do not guarantee specific academic results.
10.3. To the maximum extent permitted by applicable law, StayQrious and its officers, directors, employees, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the Services. Our total aggregate liability for any claim arising out of or relating to these Terms or the Services shall not exceed the amount of fees paid by you for Services that have not yet been delivered as of the date of the event giving rise to the claim.
10.4. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including your rights as a consumer under the Consumer Protection Act, 2019.
11. Suspension and Termination
11.1. By you. You may withdraw the Student's enrollment at any time by written notice to . Fees already paid are non-refundable as set out in Section 6.3.
11.2. By us. We may suspend or terminate an account or enrollment if: (a) these Terms are materially breached; (b) conduct on the platform or at Events endangers the safety or wellbeing of students, coaches, or staff; (c) fees remain unpaid after reasonable notice; or (d) information provided to us is found to be materially false. Except where immediate action is needed to protect safety, we will give you notice and a reasonable opportunity to respond before terminating enrollment.
11.3. On termination, your license to StayQrious Content ends, and Student Work and personal data are handled as described in Section 4 and the Privacy Policy. If termination is initiated by us without cause, the undelivered portion of fees is refunded under Section 6.4; in all other cases, fees remain non-refundable. Termination does not affect accrued rights and obligations, including any fees due.
12. Indemnity
You agree to indemnify and hold harmless StayQrious and its officers, directors, employees, and agents from claims, damages, liabilities, and reasonable expenses (including legal fees) arising from: (a) your material breach of these Terms; (b) your violation of any third-party right, including intellectual property or privacy rights; or (c) misuse of the Services through your account. This obligation survives the termination of these Terms.
13. Changes to the Services and These Terms
13.1. We continuously improve our school, and aspects of the platform, curriculum, and Services will evolve. We may modify features of the Services, and where a change materially reduces what you have paid for, we will offer an appropriate remedy.
13.2. We may update these Terms from time to time. When we make material changes, we will notify you by email or through a prominent notice on the platform before the changes take effect. Your continued use of the Services after the effective date of updated Terms constitutes acceptance; if you do not agree to a material change that adversely affects you, you may withdraw enrollment under Section 11.1, and any Services already paid for will continue to be delivered under the terms that applied at the time of payment.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Subject to applicable consumer protection law, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services.
15. General
15.1. Notices. We will send notices to your registered email or via the platform. Notices to us should be sent to .
15.2. Entire agreement. These Terms, together with the Privacy Policy, Event consent forms, and any enrollment documents and guidelines we make applicable, constitute the entire agreement between you and StayQrious regarding the Services.
15.3. Assignment. You may not assign your rights or obligations under these Terms. We may assign our rights and obligations in connection with a merger, acquisition, or sale of business, with notice to you.
15.4. Severability. If any provision of these Terms is held unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force.
15.5. Waiver. Our failure to enforce any provision is not a waiver of that provision or any right.
15.6. Relationship. Nothing in these Terms creates any employment, agency, partnership, joint venture, or franchise relationship between you and StayQrious.
15.7. Feedback. We welcome feedback about the Services. By sharing feedback, you agree we may use it to improve the Services without restriction or compensation, and that it is not confidential. This applies to feedback about our Services, not to Student Work, which is governed by Section 4.
15.8. Grievances and support. For any issues, questions, or grievances, contact us at . Grievances relating to personal data are handled by our Grievance Officer as set out in the Privacy Policy.
